NDX managed to squeak out a modest gain late in the session. JPMorgan's institutional market intelligence group officially downgraded its tactical equity stance from bullish to neutral at month-end. The team outlined six primary catalysts behind the tactical pivot. First, policy uncertainty is elevated ahead of the September FOMC meeting, where upcoming CPI on September 11 will be more decisive than payrolls. Second, institutional hedge funds sold single stocks for a second straight week, leaving momentum factors without near-term upside traction. Third, post-Labor Day corporate bond issuance is set to widen credit spreads alongside widening credit default swap spreads in AI-related names, compressing equity multiples. Fourth, September is historically the weakest month for the S&P 500 since 1928, with midterm election cycles amplifying volatility through October. Fifth, momentum indices have pulled back more than 21% from June highs, exceeding standard correction tolerances. Sixth, while AVGO reports earnings on September 2 and may deliver solid numbers, a single print will not be enough to spark a broad recovery across semiconductors and memory names.

Big Tech Litigation

The FTC and 22 state attorneys general filed an antitrust lawsuit against AMZN, alleging the company used undisclosed algorithmic soft price floors since 2019 to manipulate advertising auctions. The complaint claims this lifted minimum ad rates by 70% to 80% and generated tens of billions in extra fees. The headline sent AMZN down 3.44% intraday before buyers stepped in to trim the decline to around 2%.

Antitrust litigation is typically drawn out and ultimately resolved through settlements or fines. As seen with META, regulatory penalties represent transient noise for mega-cap balance sheets rather than structural impairment. AMZN generated $68 billion in ad revenue in 2025, ranking third globally, but AWS remains the core driver of operating profit and long-term multiple expansion. Forward valuation frameworks remain intact: 2026 forward valuation spans $212 to $285 with a midpoint of $249, while 2027 spans $241 to $323 with a midpoint of $282. The $244 to $256 range serves as strong long-term support with limited downside risk. Mega-cap leaders including AMZN, MSFT, and GOOGL continue to consolidate in low-volatility ranges, offering solid defensive resilience.

Goldman Sachs prime brokerage data confirms a regime of low net leverage and balanced two-way flows. Global hedge fund gross leverage rose 2.7 percentage points to 305.9% (52nd percentile over 1 year), while net leverage edged up to 76.9% (30th percentile). Fundamental long-short net leverage fell to 52.7%, sitting near the 3rd percentile of its annual range.

Flows showed hedge funds net selling single stocks for a second consecutive week, while net buying in macro ETF products was driven primarily by short covering rather than fresh long additions. By sector, Consumer Discretionary, Industrials, and Communication Services logged the largest global net buying, whereas Healthcare, InfoTech, and Energy led net sales. With mutual funds and passive index products near full allocation, unused hedge fund leverage will drive the fourth quarter, but institutions are maintaining dollar-neutral and market-neutral stances into September.

Historical patterns show September drawdowns consistently set up attractive fourth-quarter entry points. Since 1990, the S&P 500 has posted positive returns in 78% of the periods following midterm elections, averaging gains of 5.4% over 3 months, 11.4% over 6 months, and 14.7% over 12 months. Mutual funds also tend to preserve dry powder for deployment between October and December.

Near term, traders must watch for systematic selling pressure. Latest CTA liquidity projections indicate that flat or upward markets over the next month would trigger only moderate buying of roughly $20.8 billion, whereas a downside breakdown would unlock heavy systematic liquidation. The primary selling threshold sits near 7620 (against current levels near 7686), with secondary risk levels at 7356 and 6840. Chasing rallies into resistance is unadvised, and market focus should center on price action between 7620 and 7356.
